Au Burkina Faso, la d\u00e9centralisation a \u00e9t\u00e9 consacr\u00e9e par la Constitution comme mode d\u2019organisation du territoire. Elle a \u00e9nonc\u00e9 ses grands principes\u00a0dont celui de la libre administration qui conf\u00e8re aux collectivit\u00e9 territoriales une autonomie leur permettant de s\u2019administrer librement sans la contrainte de l\u2019Etat.<\/p>\n<p>Or, une telle absence de l\u2019Etat selon une certaine doctrine, viendrait \u00e0 remettre en cause le principe d\u2019unit\u00e9 de l\u2019Etat. Ce qui aurait pour cons\u00e9quence de cr\u00e9er une disparit\u00e9 de situations juridiques. Ainsi, le l\u00e9gislateur a \u00e9tabli trois types de contr\u00f4les de l\u2019Etat sur les collectivit\u00e9s territoriales\u00a0: la tutelle, le contr\u00f4le administratif et le contr\u00f4le juridictionnel. Parmi ces contr\u00f4les, la tutelle occupe une place importante de sorte qu\u2019elle porte \u00e0 l\u2019\u00e9vidence un s\u00e9rieux coup au principe de libre administration.<\/p>\n<p>Ce faisant, l\u2019article s\u2019interroge sur le r\u00f4le que pourrait avoir l\u2019exercice de la tutelle sur l\u2019efficacit\u00e9 des actions des collectivit\u00e9s territoriales. Cet article s\u2019int\u00e9resse donc \u00e0 l\u2019examen des fondements de la tutelle\u00a0sur les collectivit\u00e9s territoriales et ses entraves au principe de libre administration des collectivit\u00e9s territoriales.<\/p>\n<p><strong>Mots-cl\u00e9s\u00a0: <\/strong>d\u00e9centralisation, collectivit\u00e9 territoriale, libre administration, l\u00e9galit\u00e9, contr\u00f4le, tutelle, circonscription administrative.<\/p>\n<hr \/>\n<h4><strong>Abstract [EN]<\/strong><\/h4>\n<p>This article is devoted to the exercise of guardianship over territorial communities. In Burkina Faso, decentralization has been enshrined in the Constitution as a way of organizing the territory. It has set out its main principles, including that of free administration, which gives the territorial communities the autonomy allowing them to administer themselves without the State involvement.<\/p>\n<p>However, such an absence of the State could undermine the principle of State unity. This would result in creating a disparity of legal situations. Thus, the legislator has established three types of State control over the territorial communities: guardianship, administrative control and judicial control. Among these controls, guardianship occupies an important place so that it clearly strikes a serious blow at the principle of free administration.<\/p>\n<p>In doing so, the article questions the role that the exercise of guardianship could have on the effectiveness of the actions of the territorial communities.
